2. Acceptance of These Terms

By accessing or using Bellanova's website, applications, and related services (collectively, the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms and by any additional rules, notices, or policies posted within the Service that apply to specific features (together, the "Policies"). If you do not agree, do not use the Service.

3. What Bellanova Is (and Is Not)

Bellanova provides AI-generated experiences that may include chat-based "psychic" interactions, astrology-related content, readings, and other AI-generated outputs (the "AI Content"). The Service is based on emerging technology and may produce inaccurate, incomplete, or unsuitable outputs.

• Entertainment / informational use: The Service is provided for personal, non-commercial use and is intended for entertainment-style and informational experiences.
• No professional advice: The Service does not provide medical, psychological, legal, financial, or other professional advice. You must not rely on AI Content as a substitute for advice from qualified professionals.
• User responsibility: You remain solely responsible for your decisions and actions, including how you interpret or use AI Content.

4. Eligibility and Age Requirements

You may use the Service only if you can legally form a binding contract with us and you are at least 18 years old (or the age of majority in your location, if higher). By using the Service, you represent and warrant that you meet these requirements.

5. Accounts

Some features require an account. You agree to:

• provide accurate and current information during registration and keep it updated,
• maintain the confidentiality of your login credentials,
• be responsible for all activity under your account,
• not sell, transfer, or share your account or credentials with others.

We may suspend or terminate access to the Service or your account as described in Section 14.

6. Paid Features, Subscriptions, and Purchases

The Service may offer paid features, subscriptions, token/credit packs, or other purchases ("Paid Features"). By purchasing Paid Features, you agree that:

• prices, billing intervals, and available products are shown at checkout (or within the relevant purchase flow),
• subscriptions may renew automatically until cancelled in accordance with the instructions provided in the Service,
• you are responsible for all applicable charges, taxes, and payment obligations,
• payment processing may be handled by third-party processors and/or platform providers (e.g., app stores), whose terms may also apply.

Refunds, if any, are governed by the rules shown at purchase time and any applicable refund policy posted within the Service.

7. User Content and Conduct

7.1 Your content

You may submit content to the Service, including prompts, messages, uploads, feedback, or other materials ("User Content"). You retain any rights you have in your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, modify (for technical purposes), display, and otherwise use your User Content to operate, secure, maintain, and improve the Service and to provide AI-generated features.

7.2 Prohibited conduct

You agree not to misuse the Service. Prohibited conduct includes, without limitation:

• violating any applicable law or regulation,
• harassing, threatening, defaming, or abusing others,
• requesting, generating, uploading, or distributing unlawful, exploitative, or harmful content,
• attempting to exploit or harm minors or requesting content involving minors in any way,
• attempting to access accounts, systems, or data without authorization,
• reverse engineering, scraping, or extracting data from the Service except as permitted by law,
• interfering with the Service's security, rate limits, or technical measures,
• using the Service to develop or train competing models or services where prohibited by applicable Policies or technical restrictions,
• using the Service for commercial purposes unless we expressly authorize it in writing.

8. AI Content and Safety

You understand that AI Content is generated automatically and may be incorrect, fabricated, misleading, offensive, or otherwise unsuitable. You agree to use judgment and not to disclose highly sensitive information in prompts or chats (for example: passwords, full payment card details, or precise home address).

9. Intellectual Property

The Service, including all software, design, text, graphics, logos, interfaces, and other content (excluding User Content), is owned by or licensed to us and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-transferable, non-exclusive license to access and use the Service for your personal, non-commercial use.

You may not copy, modify, distribute, sell, lease, or create derivative works from any part of the Service unless you have our prior written consent.

10. Third-Party Services and Links

The Service may reference or link to third-party websites, apps, or services. We do not control and are not responsible for third-party content, products, services, or practices. Your use of third-party services is at your own risk and subject to their terms.

11. Feedback

If you submit suggestions, ideas, or feedback, you agree we may use them without restriction or compensation to you.

12. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, error-free, or that AI Content will be accurate, reliable, or suitable for your purposes.

13. Limitation of Liability

To the maximum extent permitted by law:

• We will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses.
• In any event, our total liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid to us for Paid Features in the 3 months before the event giving rise to the claim, or (b) GBP 50.

Nothing in these Terms limits liability that cannot be limited under applicable law.

14. Suspension and Termination

We may suspend, restrict, or terminate your access to the Service (including your account) at any time if we reasonably believe you have violated these Terms or if we need to protect the Service, users, or third parties. You may stop using the Service at any time. If you have a subscription, you must cancel it through the method provided in the Service or the relevant platform provider to stop future billing.

15. Indemnity

You agree to indemnify and hold harmless Nova Technologies Ltd and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Service, (b) your User Content, or (c) your violation of these Terms or applicable law.

16. Changes to the Service or Terms

We may update the Service and may modify these Terms from time to time. The "Effective date" above indicates when these Terms were last updated. Continued use of the Service after updated Terms are posted means you accept the updated Terms.

17. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, except where mandatory local law provides otherwise.

18. Miscellaneous

• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• No waiver: Failure to enforce any provision is not a waiver.
• Assignment: You may not assign your rights or obligations under these Terms without our consent. We may assign these Terms as part of a corporate transaction or otherwise.
• Entire agreement: These Terms and applicable Policies constitute the entire agreement regarding your use of the Service.
